Privacy Policy

We are very delighted that you have shown interest in our enterprise. Data protection is of a particularly high priority for the management of the Swan Rooms. The use of the Internet pages of the Swan Rooms is possible without any indication of personal data; however, if a data subject wants to use special enterprise services via our website, processing of personal data could become necessary. If the processing of personal data is necessary and there is no statutory basis for such processing, we generally obtain consent from the data subject.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to the Swan Rooms. By means of this data protection declaration, our enterprise would like to inform the general public of the nature, scope, and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed, by means of this data protection declaration, of the rights to which they are entitled.

As the controller, the Swan Rooms has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website. However, Internet-based data transmissions may in principle have security gaps, so absolute protection may not be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.

4. Cookies and consent management

The Internet pages of Swan Rooms use cookies. Cookies are text files that are stored in a computer system via an Internet browser. Many cookies contain a so-called cookie ID, a unique identifier by which Internet pages and servers can recognise the specific Internet browser in which the cookie was stored.

Our website itself sets one technically necessary session cookie. It contains only a random identifier, is used for the secure processing of forms and for the login to the internal administration area, and is deleted as soon as the Internet browser is closed. The legal basis is § 25(2) no. 2 TDDDG (German Telecommunications Digital Services Data Protection Act) and Art. 6(1) lit. f GDPR; our legitimate interest lies in the secure and functional operation of the website.

To manage consent we use the consent tool CCM19. The provider is Papoo Software & Media GmbH, Auguststraße 4, 53229 Bonn, Germany. When our website is called up, a connection to the CCM19 servers is established in order to display the consent request. In particular, the IP address, the date and time of the request and information about the browser are processed. The choice made by the data subject is stored in a cookie or in the local storage of the Internet browser so that it can be taken into account on later visits. The legal basis is Art. 6(1) lit. c GDPR in conjunction with § 25(2) no. 2 TDDDG, as we are obliged to be able to demonstrate consent given. The choice can be changed or withdrawn at any time via the cookie icon at the bottom of our website.

Further cookies may be set by the Google services described in this privacy policy (Google reCAPTCHA and Google Maps). Details are given in the respective sections.

The data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely usable, in particular the forms.

5. Collection of general data and information

The website of the Swan Rooms collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.

When using these general data and information, the Swan Rooms does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, the Swan Rooms analyzes anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

6. Hosting

Our website, the associated database and our e-mail mailboxes are operated by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. All data arising when our website is visited, when we are contacted or in the course of a reservation are processed on the servers of this provider. The provider acts on our behalf and in accordance with our instructions (processing pursuant to Art. 28 GDPR).

The legal basis is Art. 6(1) lit. f GDPR. Our legitimate interest lies in providing our website securely, quickly and reliably. Insofar as the processing serves the initiation or performance of a contract with the data subject, the legal basis is additionally Art. 6(1) lit. b GDPR.

7. Contact possibility via the website

The website of the Swan Rooms contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.

The contact form on our website collects the name, e-mail address, subject and message of the data subject. This information is delivered to us by e-mail via the mail server of our hosting provider and is used exclusively to process the enquiry. The legal basis is Art. 6(1) lit. b GDPR insofar as the enquiry is aimed at the conclusion or performance of a contract, and otherwise Art. 6(1) lit. f GDPR; our legitimate interest lies in answering the enquiries addressed to us. To protect against abusive and automated entries, the contact form is secured with Google reCAPTCHA (see the corresponding section of this privacy policy).

8. Reservation requests and bookings via the website

Rooms can be requested and booked on our website. For a reservation request, the first name, last name, e-mail address, the desired room type, arrival and departure dates, the number of guests and an optional message of the data subject are collected. To protect against abusive and automated entries, the form is secured with Google reCAPTCHA.

After we have confirmed the request, the data subject receives a personal link by e-mail with which the booking can be completed. In doing so, the address (street, postcode, city, country), telephone number and the credit card details required to guarantee the reservation (card type, cardholder, card number, expiry date and security code) are additionally collected. It is also recorded that the General Terms and Conditions have been accepted.

The data mentioned are stored in the database of our website at our hosting provider and are additionally sent to us by e-mail for processing. The data subject receives confirmations of the request and the booking by e-mail. The data are used exclusively to process the request, to carry out and invoice the stay and to secure the reservation. Data are passed on to third parties only insofar as this is necessary for the performance of the contract, in particular for payment processing, or we are legally obliged to do so.

The legal basis for the processing is Art. 6(1) lit. b GDPR, as the processing is necessary for taking steps prior to entering into a contract and for the performance of the accommodation contract. Insofar as we are subject to statutory retention obligations, the legal basis is Art. 6(1) lit. c GDPR. The provision of the data is necessary for a reservation; without this information a reservation via the website cannot be processed.

The data are erased as soon as they are no longer necessary for the purposes mentioned and no statutory retention obligations, in particular under commercial and tax law, prevent this. Data from requests that do not lead to a booking are erased as soon as the request has been conclusively dealt with.

9. Routine erasure and blocking of personal data

The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

An employee of Swan Rooms shall promptly ensure that the erasure request is complied with immediately.

Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the Swan Rooms, he or she may at any time contact any employee of the controller. The employee of the Swan Rooms will arrange the restriction of the processing.

11. Data protection provisions about the application and use of Google reCAPTCHA

On this website, the controller has integrated the Google reCAPTCHA component. reCAPTCHA is used to check whether entries in our forms (contact form and reservation request) are made by a human being or abusively by an automated program. The purpose is to protect our website against spam and abuse.

For users in the European Economic Area and Switzerland, the operating company of Google reCAPTCHA is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Ireland Limited is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

The reCAPTCHA component is loaded from Google's servers when our website is called up. In particular, the IP address of the data subject, the date and time of the request, the address of the page called up, information about the browser and device used and information about user behaviour on the page (for example mouse movements and time spent) are transmitted to Google. Google may set cookies for this purpose and read existing Google cookies. When a form is submitted, we transmit the result of the check and the IP address of the data subject to Google for verification.

Insofar as we obtain the consent of the data subject via our consent tool, the legal basis is Art. 6(1) lit. a GDPR in conjunction with § 25(1) TDDDG; consent may be withdrawn at any time with effect for the future via the cookie icon at the bottom of our website. Otherwise, the processing is based on Art. 6(1) lit. f GDPR; our legitimate interest lies in protecting our forms against abuse and spam.

The data may also be transmitted to Google LLC in the United States. Google LLC is certified under the EU-U.S. Data Privacy Framework; an adequacy decision of the European Commission pursuant to Art. 45 GDPR applies to these transfers.

Further information and the applicable data protection provisions of Google may be retrieved under https://policies.google.com/privacy?hl=en.

12. Data protection provisions about the application and use of Google Fonts

For the uniform display of fonts, this website uses fonts provided by the Google Fonts service (Lato and Work Sans). For users in the European Economic Area and Switzerland, the operating company is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The fonts are loaded from Google's servers (fonts.googleapis.com and fonts.gstatic.com) when our website is called up. As a result, Google learns that our website was called up via the IP address of the data subject. In particular, the IP address, the date and time of the request and information about the browser and device used are transmitted. According to Google, no cookies are set by Google Fonts. E-mails that we send in connection with requests and bookings may also load these fonts from Google's servers when opened, provided that the e-mail program of the data subject permits the loading of external content.

Insofar as we obtain the consent of the data subject via our consent tool, the legal basis is Art. 6(1) lit. a GDPR; consent may be withdrawn at any time with effect for the future via the cookie icon at the bottom of our website. Otherwise, the processing is based on Art. 6(1) lit. f GDPR; our legitimate interest lies in a uniform and appealing presentation of our website.

The data may also be transmitted to Google LLC in the United States. Google LLC is certified under the EU-U.S. Data Privacy Framework. Further information may be retrieved under https://developers.google.com/fonts/faq/privacy and https://policies.google.com/privacy?hl=en.

13. Data protection provisions about the application and use of Google Maps

In the contact section of this website, the controller has integrated a map provided by the Google Maps service in order to show the location of Swan Rooms and to make it easier to find us. In addition, the address is linked to Google Maps.

For users in the European Economic Area and Switzerland, the operating company of Google Maps is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Ireland Limited is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

The map is not loaded automatically. When our website is called up, only a placeholder is displayed at first; no connection to Google's servers is established. The map is loaded from Google's servers only when the data subject clicks the "Show map" button. The same applies if the data subject clicks the link in the address and thereby opens Google Maps in a new window.

When the map is loaded, Google learns that our website was called up via the IP address of the data subject. In particular, the IP address, the date and time of the request, the address of the page called up and information about the browser and device used are transmitted to Google. Google may also place cookies on the information technology system of the data subject. If the data subject is logged in to Google at the same time, Google can assign the request to their Google account. We have no influence on the further processing of the data by Google.

The legal basis for the processing is the consent of the data subject pursuant to Art. 6(1) lit. a GDPR, which is given by clicking the "Show map" button. Consent is voluntary; our website can be used in full without the map. Consent may be withdrawn at any time with effect for the future. After our website has been reloaded, the map is no longer displayed until the button is clicked again.

The terms of service of Google Maps are available under https://www.google.com/intl/en/help/terms_maps/.

14. Other content loaded from external servers

To ensure that our website works technically and is displayed correctly, individual program libraries and icon fonts are loaded from external servers:

a) the JavaScript library jQuery from the server code.jquery.com. The provider is the OpenJS Foundation, 548 Market St, PMB 57274, San Francisco, CA 94104-5401, United States.

b) the icon font Linearicons from the server cdn.linearicons.com. The provider is Perxis (https://linearicons.com).

When this content is loaded, a connection is established to the servers mentioned or to the content delivery networks used by the providers. In particular, the IP address of the data subject, the date and time of the request and information about the browser used are transmitted. The servers may be located outside the European Union, in particular in the United States. We have no influence on the further processing by the providers.

The legal basis is Art. 6(1) lit. f GDPR. Our legitimate interest lies in providing our website quickly and in a technically flawless manner.

15. Legal basis for the processing

Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR. Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

16. The legitimate interests pursued by the controller or by a third party

Where the processing of personal data is based on Article 6(1) lit. f GDPR our legitimate interest is to carry out our business in favor of the well-being of all our employees and the shareholders.

17. Period for which the personal data will be stored

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

18. Provision of personal data as statutory or contractual requirement; Requirement necessary to enter into a contract; Obligation of the data subject to provide the personal data; possible consequences of failure to provide such data

We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary to conclude a contract that the data subject provides us with personal data, which must subsequently be processed by us. The data subject is, for example, obliged to provide us with personal data when our company signs a contract with him or her. The non-provision of the personal data would have the consequence that the contract with the data subject could not be concluded. Before personal data is provided by the data subject, the data subject must contact any employee. The employee clarifies to the data subject whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and the consequences of non-provision of the personal data.

19. Existence of automated decision-making

As a responsible company, we do not use automatic decision-making or profiling.
